Where do I get the FTC Identity Theft Affidavit?

At IdentityTheft.gov. You answer questions about what happened and the site generates the affidavit and your Identity Theft Report for you. There is no fee, and you do not need a lawyer to complete it.

Does the identity theft affidavit need to be notarized?

The FTC affidavit generated at IdentityTheft.gov is signed under penalty of perjury and is not generally required to be notarized for the credit bureaus. Individual companies sometimes ask for notarization as their own policy. If one does, notarizing costs little and removes their excuse.

What is the difference between the affidavit and the Identity Theft Report?

The affidavit is your sworn statement of what happened. The Identity Theft Report is the completed filing that IdentityTheft.gov produces from it. The FCRA requires an identity theft report for a 605B block, and the FTC states the IdentityTheft.gov report is sufficient for the credit bureaus and most companies.

What happens if I get a detail wrong on the affidavit?

Correct it as soon as you notice. The FCRA lets a bureau decline or rescind a 605B block if it was based on a material misrepresentation of the facts, so an inaccurate affidavit can cost you the block. An honest correction is far safer than leaving a wrong date or amount in place.

Can I file an affidavit if I do not know which accounts are fraudulent yet?

Pull all three credit reports first. The affidavit asks you to identify what was taken and which accounts are affected, and a bureau needs you to identify the specific information before the 4 business day block clock can start. File once you can name the accounts.
