How long does a repossession stay on your credit report?

A repossession stays on your credit report for seven years. The Fair Credit Reporting Act, 15 U.S.C. 1681c(a)(5), excludes any adverse item that antedates the report by more than seven years, and 1681c(c)(1) starts that clock 180 days after the first delinquency that led to the repossession. In practice the bureaus and FICO both describe it as seven years from your first missed payment, not from the tow date or the auction date.

Can a repossession be removed from your credit report?

An accurate repossession cannot be removed before the seven-year period ends, and no company can lawfully promise otherwise. An inaccurate one can. Under 15 U.S.C. 1681i(a)(5)(A), a credit bureau must delete or modify any disputed item it cannot verify. The winning disputes are factual: a wrong first-delinquency date, a balance that ignores the auction proceeds, a deficiency reported twice, or an account that is not yours.

What is a deficiency balance after a repossession?

The FTC defines a deficiency as the difference between what you owe on your contract, plus certain expenses, and what your lender gets for selling the car. The CFPB gives this example: owe $10,000, the lender sells for $7,500, and you owe $2,500 plus repossession fees. In the CFPB's January 2025 auto finance dataset, 94 percent of the 905,000 vehicle disposals ended with a deficiency balance.

Is voluntary surrender better than a repossession?

Only slightly, and not in the way most people hope. The FTC states that even if you return the car voluntarily you still owe the difference between the contract balance and the sale price. The CFPB counts voluntary surrenders inside its repossession data. Experian says a voluntary repossession is noted on your report and stays seven years. FICO says surrendering voluntarily may reduce the damage, even if only a little.

How long does a debt collector have to validate a deficiency balance?

You have 30 days. Under 15 U.S.C. 1692g(b), if you dispute the debt in writing within 30 days of the collector's first notice, the collector must stop collecting until it mails you verification of the debt or a copy of a judgment. Send it by certified mail with return receipt. Separately, Regulation F at 12 CFR 1006.14(b)(2) presumes a violation when a collector calls more than seven times in seven consecutive days.

How much does a repo hurt my credit score?

There is no honest point figure, and FICO says so directly: "it's difficult to say exactly how much any individual item will decrease your FICO Scores." The damage is also not one entry. FICO lists the late payments, the loan default as a separate event, the repossession of the collateral, and a collection account on the unpaid deficiency. Payment history is the most influential factor in a FICO Score at 35 percent, which is why the run of missed payments before the tow often costs more than the repossession line itself. Anyone quoting you an exact point drop is guessing.

Can I get a new car loan after repossession?

Usually yes, but on worse terms, and lenders do originate well below the median. In the Federal Reserve Bank of New York's 2026 Q2 Household Debt and Credit data, the median credit score at auto loan origination was 716, while the 25th percentile was 639 and the 10th percentile was 580. So roughly one in ten new auto loans went to a borrower scoring at or below 580. Expect a higher rate and a larger down payment. Rebuilding on-time payment history first is what moves the terms.
